1. Introduction
These Terms and Conditions (T&Cs) apply to all contracts between mezzalyn. and its customers for services in baubiological consulting and the certification of living spaces. By using our website and booking our services, you agree to be bound by these T&Cs. Our mission is to help you create a healthier and more sustainable home environment.
2. Subject of the Contract
mezzalyn. offers freelance services in baubiological consulting and the certification of residential spaces. Our services are provided as a system under the names “GreenValue” (for hourly consulting) and “FairLiving” (for project-based consulting), in addition to the “Masterclass” online course. Our clients are primarily property developers, real estate agents, and individuals who want to create or certify healthy and sustainable living spaces.
3. Consulting and Certification
a. Consulting:
- GreenValue: Our baubiological consulting for smaller projects is offered at a flexible hourly rate of 118 € per hour (billed in 15-minute increments). Consulting can be provided on-site or via common meeting platforms. Travel costs will not be charged for on-site appointments. This service includes a concise audit report with practical recommendations to get you started quickly.
- FairLiving: For medium-sized projects, such as multi-unit residential buildings (up to 12 units), our baubiological consulting is available as a complete package for a fixed price of 1,497 €. This comprehensive service includes a detailed assessment and a full report on how to improve the living environment.
- Masterclass: The online course is available for 69 € and can be accessed at masterclass.mezzalyn.com. Please note that separate T&Cs for the Masterclass can be found on its dedicated website.
b. Certification: After the consultation and review of the submitted documents, the residential space is certified. This certification can be verified online for authenticity using a specific code. The certification is based on the SBM-2024 standard. Certificates reflect the current condition of the property, and mezzalyn. assumes no liability for changes made to the property after certification.
4. Conclusion of the Contract and Payment Terms
a. Conclusion of Contract: The contract is concluded when a service package is booked via the mezzalyn. website. The client must provide the necessary documents for the consulting and certification process. Payments are securely processed via the Stripe payment solution. b. Payment Terms: Payments for all services are to be made in advance when booking the service. Upon payment, the client will receive a link to a form to provide the necessary data for certification.
5. Cancellation and Refund
a. Client Cancellation: The client has the right to cancel the contract within 14 days of booking without providing a reason. After this period, cancellation is no longer possible. b. No Refund Policy: mezzalyn. does not offer refunds if the client fails to provide the required documents on time or decides not to use the service after payment has been made.
6. Liability and Warranty
a. Limitation of Liability: mezzalyn. does not assume liability or warranty for the accuracy of the certificates, as the condition of the property may change after certification (e.g., through renovations or alterations). We are not liable for damages that occur after certification unless they are caused by gross negligence or willful misconduct by mezzalyn. b. Liability for Damages: mezzalyn. is not liable for damages resulting from the use of the service unless such damages are caused by gross negligence or willful misconduct by mezzalyn. Our liability is limited to the value of the service provided. c. Fraud Attempts and Claims for Damages: mezzalyn. reserves the right to take legal action against fraudulent activities, unjustified claims for damages, or attempted extortion. We are not liable for unfounded claims for damages based on false or incomplete information.
7. Data Protection
mezzalyn. stores customer data in its CRM system for the purpose of processing and fulfilling the service. The data is used exclusively for the performance of the contract and will not be shared with third parties. For more information, please refer to our Privacy Policy on our website.
8. Jurisdiction and Applicable Law
a. Jurisdiction: The jurisdiction for all disputes related to this contract is Lisbon, Portugal. b. Applicable Law: The laws of the European Union and Portugal apply.
